Mary Jean’s practice centers around health care reimbursement, regulatory compliance and transactional issues. She represents physician groups, hospitals, multi-hospital corporations and a variety of other types of health care providers. In her previous career, Mary Jean worked in health care administration for more than 15 years, during which time she served as a hospital CEO. Her leadership and management experience give Mary Jean a unique perspective and understanding of many challenges faced by health care clients.

Advises physicians, hospitals and other health care providers on reimbursement matters, including assisting in responding to Medicare overpayment situations, coding and compliance, commercial health plan contracting and payment disputes with commercial government health plans.

Represents physician groups in a variety of matters, including practice structure, health plan and Medicare reimbursement problems and compliance, development of ancillary business and compliance with federal laws such as Stark, Anti-kickback and HIPAA.

Provides advice to hospitals, physicians and other providers on compliance with state and federal laws and regulations, including state licensing laws, Medicare conditions of participation, HIPAA, EMTALA, JCAHO, and a variety of day to day operational issues and questions.

Represented a managed care organization in dispute with the State over interpretation of State statutes and regulations governing involuntary hospitalizations of minor children.

Represents hospitals in disputes with the Texas Department of State Health Services and/or CMS related to compliance with licensing standards and the Medicare conditions of participation.

Analyzes transactions and entity structures for compliance with the federal and state fraud and abuse laws, including Stark and Anti-kickback laws.

Assists hospitals in drafting medical staff bylaws, credentialing policies and procedures, and rules and regulations.

Advises organizations and provides on a variety of business matters and produces the necessary corporate documents and agreements, including management services agreements, physician employment agreements, shareholder agreements, physician coverage agreements, physician recruiting agreements and corporate formation documents and bylaws.

Advises hospitals on enforcement and management of corporate compliance programs, and assist with compliance investigations in cases of suspected violations of federal law.
